Father seeks custody of child adopted without his consent

On Behalf of | Jan 16, 2014 | Child Custody |

Imagine finding out that you are going to be a parent for the first time. Your emotions are probably all over the place: joy, nervousness, excitement and fear, just to name a few. Becoming a parent in Lake County, Illinois is a life-changing experience which many people look forward to.

A man who was planning on being there to help raise his baby boy was robbed of the opportunity when the child was placed for adoption without his consent. The baby was born December, 29, 2010 and was placed for adoption the next day, all without the biological father’s knowledge. It turns out the mother of the child was still married to her estranged husband when the baby was born, and therefore he was legally presumed to be the father in the state where they lived. Because of this, he had the legal right to put the baby up for adoption.

The biological father is suing the mother of his child for placing the baby for adoption without his knowledge. He is seeking $130 million in damages and is also fighting for child custody of the boy, who is now three years old. The father has yet to meet his son.

If you are an expectant father who is not married to the mother of your unborn child, it is important that you take the steps necessary in order to protect your paternal rights legally. Doing so may be able to help you avoid becoming involved in a situation like this where you are subject to losing parental rights to your child.
