Man refuses to pay alimony, claims marriage was invalid

The vast majority of people in Illinois believe that they know everything that they need to know about the person with whom they plan to spend the rest of their life. However, in some situations, one person may find out certain information only after they exchange vows, often prompting the decision to seek a divorce. Unfortunately, a man in another state claims that he faces alimony payments even though he believes that the marriage was not valid.

The couple, a 42-year-old woman and a 56-year-old man, reportedly met through mutual friends and decided to marry in Aug. 2017. However, the man claims he learned after they were married that the woman had a criminal history, information that he says was new to him. He ultimately chose to file for a divorce five months after their marriage.

In Feb. 2019, the woman was indicted on bigamy charges. Claiming that the woman was married to "several" men at the time of their wedding, he says that their marriage is invalid. Both state and federal laws indicate that if a person is married, any additional marriage is invalid. Despite this argument, reports indicate that a judge has ordered the man to pay the woman $73,000 in alimony. Failure to pay will result in jail time.

The man, who says he will not pay, is worried about the impact jail time will have on his autistic son who has no one else to care for him. Unfortunately, one of the consequences of failing to make court-ordered child support or alimony payments can be imprisonment. Because of the stakes of cases like this, most people in Illinois and across the country want an attorney by their side who can ensure that the court hears all relevant information as a decision is made and take additional action if a judgment is believed to be in error.
