Illinois Lawyers Supporting The Rights Of Fathers

As a father going through a divorce or family law case, you may wonder if you have the same rights as your children’s mother with respect to child support, the allocation of parental responsibilities (formerly known as child custody), and parenting time (formerly known as visitation). Although Illinois law allows no explicit bias, many fathers feel as though they are at a disadvantage when it comes to their children — that the deck is always stacked in favor of mom.

At Kulinsky & Associates Ltd, we understand your concerns, and we work hard to protect the rights of dads who are concerned about losing touch with their children following divorce. If you are considering a divorce or another proceeding involving your kids, turn to Lois Kulinsky and her team of talented attorneys and staff. We have been helping people just like you since 1983, and we are ready to discuss your options.

Protecting Dads’ Rights In Illinois Divorces And Family Law Cases

Our firm realizes that it is important for a child to have a strong, long-lasting relationship with his or her father. With a strong paternal figure in a child’s life, he or she is prone to do better in school, have better relationships as an adult, and have fewer problems with drugs or alcohol. In short, it is often in the child’s best interests to maintain a good, frequent relationship with his or her father.

Illinois recently revised its Marriage and Dissolution of Marriage Act to reflect the changing nature of the modern family and to support the rights of fathers. That change is reflected in the choice of new legal terminology:

  • “Child custody” is now referred to as “the allocation of parental responsibilities.”
  • What was once referred to as “visitation” is now called “parenting time.”

We believe that fathers have a right to be involved in their children’s lives, and that everyone is better off when children have strong relationships with both of their parents. Our attorneys will work with you to obtain a parenting order that meets your needs while being in the best interest of your children. We can also assist you with child support issues and any concerns specific to your own situation.

Establishing Legal Paternity

A common problem fathers encounter is the need to establish the paternity of a child. Doing so is necessary to establish a father’s right to be a part of his son’s or daughter’s life. When you visit our office, we will discuss the many options you have available to recognize you as a child’s legal father, ranging from acknowledgment to DNA testing.

Once your legal right is recognized, we will work with you and the child’s mother to set up child custody and visitation (allocation of parental responsibilities and parenting time) arrangements, as well as determine what amount of child support is appropriate, if necessary.
