What is Probate?
Probate is the legal process of proving a will is valid after the will's holder has died, or of administering estates when the decedent does not have a will. In Illinois, probate attorneys must first file the will with the appropriate court, then petition to have the court approve it and appoint an executor. The executor then administers the estate once it is approved by the court. If the will is not approved, the court distributes the estate according to Illinois law.
Even though the probate process has become much more efficient in the last 20 years, it is still often lengthy and expensive. Avoiding Probate
There are ways to avoid probate altogether through careful estate planning. For example, if you put your assets in a trust of some type, such as a revocable living trust, you will be able to bypass all probate proceedings. Placing real estate in a land trust can also accomplish this goal. Also, with a will, there is a six-month creditors' waiting period before disbursement. With trusts, there is no waiting period.
