In any divorce, the welfare of the children must be a top priority. At Lois Kulinsky & Associates, Ltd., our attorneys are always focused on the best interests of the children involved in Illinois child custody and divorce matters.

Our lawyers want to help you understand Illinois child custody and visitation laws. We encourage you to read the following and contact us with any questions. If you need more information, we also have a Family Law FAQ and family law articles.

Types of Custody

Our lawyers work hard to get the best possible custody arrangement, using the right combinations of different types of Illinois child custody. Physical (residential) custody determines which parent the child lives with, while legal custody allows both parents to determine major decisions about the child's schooling, medical care, etc.

Joint custody gives both parents equal rights on major child related issues, while sole custody gives one parent the rights.

In a joint legal custody arrangement, both parents have equal say about the child's major life decisions.

Visitation

Few people realize that as part of a visitation agreement, you can not force the parent to visit with the child at the designated time if the parent doesn't want to visit. You can force a custodial parent to make a child available for visitation, provided you are following the schedule that you agreed upon.

Removal of Children

When you have custody of a child, you must get a court order before you move him or her to another state. The other parent has a right to visit with the child without having to travel to a different state. Even if you were never married, and paternity has been established, you must get a court order before moving out of state.
