Alimony (Spousal Support or Maintenance)

Spousal maintenance is a complex matter, and an attorney should take all of its aspects into account while drafting a divorce agreement. For example, the maintenance that a person receives is taxable. Meanwhile, the person paying maintenance can deduct the amount from his or her gross income, thus saving income taxes.

Child Support

Illinois child support law has basic guidelines for the amount of support that should be provided. Typically, 20% of the payor's income will be paid for one child, 28% for two children, and 32% for three children. Child Support is not tax deductible by the person paying it, and the person receiving it does not pay taxes on it.

The recipient has the right to be paid through a notice for withholding with the payor's employer. Child support is then automatically deducted from the person's paycheck. Our child support lawyers can also make arrangements for unallocated family support, in which alimony (maintenance) and child support are combined into one payment and tax deductible to the payor.
